Terms and Conditions for Mobile Pre-Purchase Vehicle Inspection Services
These Terms and Conditions ("Terms") govern the provision of mobile pre-purchase inspection services ("Services") for used vehicles by Car Advisors LLC ("we," "us," or "our"). By requesting, scheduling, or accepting the Services, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, do not proceed with the Services.
These Terms are intended to provide a clear understanding of our Services and limitations. They are not a substitute for legal advice. Please consult an attorney for personalized guidance.
1. Services Provided
- We offer mobile inspections of used vehicles at a location of your choice, including a visual and basic mechanical examination of the vehicle's exterior, interior, engine, and undercarriage (the "Inspection").
- The Inspection aims to identify visible defects, wear, and potential issues based on the inspector's professional judgment at the time of service.
- An online report ("Report") will be provided summarizing findings. The Report is for informational purposes only and does not constitute a certification, appraisal, or valuation of the vehicle.
- Services do not include repairs, towing, or any post-inspection actions. Additional fees may apply for vehicles located outside service area if requested and agreed upon in advance.
- Inspections may be conducted with or without the Customer present, as specified at the time of scheduling.
2. Scheduling and Cancellation
- Appointments are scheduled based on availability. We will confirm the date, time, and location via calls or text.
- Cancellations are possible up to 1 hour before the scheduled Inspection time with no fee. Cancellations made less than 1 hour before the Inspection, including no-shows, may incur a $50 cancellation fee.
- We reserve the right to reschedule or cancel due to inclement weather, vehicle inaccessibility, or other unforeseen circumstances, with no liability for resulting delays.
3. Payment Terms
- Payment Obligation: Payment terms depend on Customer attendance:
- If the Customer attends the Inspection, full payment is due immediately upon completion of the Inspection.
- If the Inspection is conducted without the Customer present, full payment is due upfront, prior to scheduling or commencement of the Services.
- Accepted payment methods include credit/debit card, check or cash.
- No Refunds: All fees are non-refundable once the Inspection begins or the Report is delivered. This includes cases where the Customer is dissatisfied with the findings or decides not to purchase the vehicle.
- Dispute Protection: By providing payment information and authorizing the charge, you acknowledge that:
- The Services have been requested and agreed upon.
- You have received (or will receive) the Report as described.
- Any disputes regarding the quality or completeness of the Services must be raised in writing within 48 hours of the Inspection, but this does not entitle you to a refund or reversal of payment.
- We reserve the right to charge additional fees for returned payments, collection efforts, or disputes initiated through your payment provider (e.g., chargebacks). You agree to reimburse us for any such costs, including reasonable attorney fees.
- Late payments accrue interest at 1.5% per month or the maximum allowed by law, whichever is lower.
4. Limitations and Disclaimers
- Not a Warranty: The Inspection and Report are not a warranty, guarantee, or endorsement of the vehicle's condition, safety, reliability, or future performance. We do not warrant that the vehicle is free from defects or suitable for any purpose.
- Hidden Issues: Due to the nature of used vehicles, some issues may be hidden, intermittent, or undetectable without disassembly, specialized testing, or extended use (e.g., electrical faults, or latent mechanical failures). Our Inspection is limited to what is reasonably observable at the time and place of service. You acknowledge that undiscovered issues may exist, and we are not liable for them.
- No Liability for Vehicle Purchase Decisions: Any decision to purchase, sell, or otherwise act on the Report is solely your responsibility. We are not responsible for the accuracy of vehicle history reports, title issues or third-party information.
- Assumptions: The Inspection assumes the vehicle is in a drivable condition, accessible, and registered or has dealer's plate. If the vehicle cannot be safely inspected, the Inspection may be incomplete, and no refund will be issued.
5. Liability Limitations
- Maximum Liability: Our total liability for any claim arising from the Services (including negligence) is limited to the fee paid for the Inspection. We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, vehicle repair costs, or purchase price losses.
- Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Report, misrepresentation of vehicle information, or third-party actions related to the inspected vehicle.
- Force Majeure: We are not liable for delays or failures due to events beyond our control, such as weather, pandemics, or supply chain issues.
6. Dispute Resolution
- Informal Resolution: Any disputes must first be addressed in writing to contact@caradvisors.pro within 7 days of the Inspection. We will respond within 10 business days.
- Binding Arbitration: Any unresolved disputes will be settled by binding arbitration under the rules of the American Arbitration Association (or equivalent in your jurisdiction), conducted remotely or in Atlanta, Georgia. You waive the right to class actions or jury trials.
- Small Claims Exception: Disputes under $10,000 may be brought in small claims court in Atlanta, Georgia.
7. Governing Law
These Terms are governed by the laws of Georgia, USA, without regard to conflict of laws principles. Any legal action must be brought in Cobb County, Georgia courts.
8. Miscellaneous
- Entire Agreement: These Terms constitute the full agreement between us and supersede any prior understandings.
- Severability: If any provision is invalid, the remainder remains enforceable.
- Amendments: We may update these Terms without notice. Continued use of our Services after changes constitutes acceptance.
- Privacy: We respect your privacy; personal information is handled per our Privacy Policy.
